PARTICIPATION WAIVER & RELEASE
PLEASE READ CAREFULLY — THIS IS A LEGAL AGREEMENT
By signing this agreement, you are giving up certain legal rights, including the right to sue and the right to a jury trial, to the fullest extent permitted by Massachusetts law.
1. Activities Covered. This agreement applies to all martial arts, fitness, and related activities offered by Sigma Martial Arts, LLC (“Sigma”), including classes, sparring, training, competitions, camps, demonstrations, special events, off-site activities, and the use of Sigma’s facilities, equipment, and services.
2. Risks of Participation. I understand that these activities involve physical contact and strenuous exertion and carry inherent risks. These risks include, without limitation: falls, collisions, strains, sprains, broken bones, concussions, illness, communicable diseases, equipment failure, property damage, serious injury, disability, or death.
3. Assumption of Risk. I voluntarily choose to participate and knowingly assume all risks, whether known or unknown, inherent or otherwise, arising from my participation.
4. Release and Waiver of Liability. To the maximum extent permitted by Massachusetts law, I release and waive any claims against Sigma and its owners, officers, instructors, employees, contractors, volunteers, and affiliates for injury, loss, or damage arising out of or related to my participation.
5. Indemnification. I agree to defend, indemnify, and hold harmless Sigma from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) brought by third parties that arise out of or relate to my participation.
6. Medical Treatment. If Sigma staff reasonably believe emergency medical treatment is necessary, I authorize them to obtain such treatment on my behalf. I understand that I am solely responsible for all medical costs incurred.
7. Media Release. I grant Sigma the unrestricted right to use my name, image, likeness, and voice in photographs, videos, or recordings for lawful promotional, marketing, or educational purposes, without compensation.
8. Jury Trial Waiver. I KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY in any lawsuit, action, or proceeding arising out of or relating to my participation in Sigma activities or this agreement, to the fullest extent permitted by Massachusetts law.
9. Severability and Binding Effect. If any provision of this agreement is held unenforceable, the remaining provisions will remain in full force and effect. This agreement is intended to be as broad and inclusive as permitted by Massachusetts law. This agreement is binding on me and my heirs, executors, administrators, and assigns.
10. Governing Law and Venue. This agreement is governed by Massachusetts law. Any legal action must be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts.
11. Additional Terms for Minors (Under 18). I am the parent or legal guardian of the minor participant named below.

I consent to the minor’s participation in all Sigma activities.

I understand that Massachusetts law does not allow a parent or guardian to waive a minor’s own personal injury claims in advance.

To the fullest extent permitted by law, I release Sigma from any claims I may personally have arising from the minor’s participation.

I agree to defend, indemnify, and hold harmless Sigma from claims brought by or on behalf of the minor, to the extent permitted by law.

I authorize emergency medical treatment for the minor and agree to be responsible for all related costs.

I grant the media release above on the minor’s behalf.
Acknowledgment. I have read this agreement carefully, understand its terms, and sign it voluntarily, intending it to be legally binding to the fullest extent permitted by law.
